הסכמה

יצירת חשבון או שימוש באפליקציה מהווה הסכמה לתנאים האלה ולמדיניות הפרטיות. אם אינכם מסכימים — אל תיצרו חשבון.

מי יכול ליצור חשבון

חשבון יכול ליצור רק בגיר (לרוב מעל 18, או גיל הבגרות במדינתכם). קיימים שני סוגי חשבון, לפי הפלטפורמה:

חשבון הורה (באפליקציה לנייד): נועד להורה או אפוטרופוס חוקי של הילד שייעשה בו שימוש. בעת יצירת החשבון אתם מצהירים שאתם בגירים ומורשים להסכים בשם הילד — כולל הסכמה להקלטת ושמירת קולו של הילד, אם בחרתם בכך.

חשבון קלינאי/ת (באתר האינטרנט): נועד לקלינאי/ת תקשורת שמשתמש/ת בדיבור ככלי מקצועי לליווי מטופלים. בעת יצירת החשבון את/ה מצהיר/ה שאת/ה קלינאי/ת תקשורת מוסמכ/ת או עוסק/ת בתחום, ושלכל מטופל שתזמין/י תשיג/י את הסכמת ההורה או האפוטרופוס ותשתמש/י בנתונים למטרות קליניות בלבד.

המסלול הקליני — אחריות הקלינאי/ת

אם את/ה משתמש/ת בחשבון קלינאי/ת, את/ה מסכים/ה כי: (א) האחריות להשיג את הסכמת ההורה/אפוטרופוס לכל מטופל, לפני איסוף ושמירת הקלטות, מוטלת עליך; (ב) הגישה למטופלים ולהקלטותיהם תשמש אך ורק להערכה ולטיפול, ותוך שמירה על סודיות מקצועית; (ג) את/ה אחראי/ת לדיוק הפרטים שהזנת ולשמירת פרטי הכניסה שלך, ואין להעביר את החשבון לאחר; (ד) דיבור הוא כלי תומך בלבד — אינו מכשור רפואי ואינו מחליף את שיקול הדעת הקליני שלך.

החשבון שלכם

אתם אחראים לדיוק הפרטים בחשבון ולשמירה על פרטי הכניסה שלכם. אסור להעביר את החשבון למישהו אחר. ניתן למחוק את החשבון בכל רגע — הורים מ"אזור הורים" באפליקציה, וקלינאים מלוח הבקרה באתר.

שימוש נאות

אסור לנסות לפרוץ לאפליקציה, לבצע scraping, לחבר רובוטים אוטומטיים, להעלות תוכן זדוני, או להפר חוק בעת השימוש. אסור להשתמש בשירות לכל מטרה למעט תרגול ההיגוי שלשמו נועד.

השירות

אנחנו מספקים את האפליקציה "כפי שהיא" (As-Is). ייתכנו באגים, תקלות זמניות, ושינויי תכונות. אנחנו עושים מאמץ סביר לשירות יציב אך לא מתחייבים לזמינות 100%.

דיבור היא כלי לתרגול ותמיכה בלבד. היא אינה מכשור רפואי ואינה תחליף לאבחון או לטיפול מקצועי של קלינאי/ת תקשורת.

תוכן והקלטות של הילד

ניסיונות ההגייה של הילד וההקלטות הקוליות שלו שייכים לילד ולכם, ההורים. אנחנו מקבלים רישיון מוגבל בלבד — לעבד אותם לשם מתן השירות (ניקוד הגייה, והצגתם לקלינאי/ת התקשורת אם נתתם הסכמה לכך), ורק אם אישרתם זאת בנפרד — לשיפור מנוע זיהוי הדיבור שלנו. אין לנו זכות להשתמש בהם לפרסום, למכירה, או לכל מטרה אחרת.

סיום

אתם רשאים למחוק את החשבון בכל רגע מ"אזור הורים". אנחנו רשאים להשעות חשבון אם זוהו הפרות חמורות של התנאים (למשל שימוש לרעה או ניסיון חדירה לחשבונות אחרים). במידת האפשר ננסה ליצור קשר לפני השעיה.

הגבלת אחריות

במידת הניתן לפי חוק, אחריותנו מוגבלת לסכומים ששילמתם לנו ב-12 החודשים שקדמו לאירוע (אם בכלל). אנחנו לא אחראים לנזק עקיף, אובדן נתונים, או אובדן רווחים. שום דבר בתנאים אלה אינו מגביל אחריות שלא ניתן להגביל לפי חוק (למשל נזקי גוף ישירים או מרמה).

דין החל וסמכות שיפוט

התנאים כפופים לדין הישראלי. כל סכסוך ידון בבתי המשפט המוסמכים בתל אביב-יפו. אם אתם משתמשים מהאיחוד האירופי או הממלכה המאוחדת, אתם זכאים לזכויות שמקנה לכם החוק המקומי, ושום דבר בסעיף זה לא גורע מהן.

שינויים בתנאים

נודיע על שינויים מהותיים בדוא״ל ונבקש את אישורכם המחודש. שינויים מינוריים יפורסמו כאן עם תאריך עדכון חדש.

Acceptance

Creating an account or using the app means you agree to these Terms and the Privacy Policy. If you do not agree, do not create an account.

Who can create an account

Only an adult (typically 18+, or your country's age of majority) may create an account. There are two account types, by platform:

Parent account (mobile app): for the parent or legal guardian of the child who will use it. By creating it, you affirm you are an adult and authorized to consent on the child's behalf — including, if you choose, consent to record and store the child's voice.

Clinician account (website): for a speech-language clinician who uses Dibur as a professional tool to support patients. By creating it, you affirm you are a licensed or practicing speech-language clinician, and that for every patient you invite you will obtain the parent's or guardian's consent and use the data for clinical purposes only.

Clinical track — clinician responsibilities

If you use a clinician account, you agree that: (a) obtaining the parent's/guardian's consent for each patient, before recordings are collected and stored, is your responsibility; (b) access to patients and their recordings is used solely for assessment and treatment, and under professional confidentiality; (c) you are responsible for the accuracy of the details you enter and for keeping your credentials safe, and you may not transfer the account to anyone; (d) Dibur is a support tool only — not a medical device, and not a substitute for your clinical judgment.

Your account

You are responsible for the accuracy of your account details and for keeping your credentials safe. Do not transfer your account to anyone else. You may delete your account anytime — parents from the Parent Area in the app, clinicians from the dashboard on the website.

Acceptable use

You may not attempt to break into the app, perform scraping, run automated bots, upload malicious content, or violate any law while using the service. The service is only to be used for the articulation practice it is intended for.

The service

We provide the app "as is." There may be bugs, occasional outages, and feature changes. We make reasonable efforts for a stable service but do not guarantee 100% availability.

Dibur is a practice and support tool only. It is not a medical device and is not a substitute for professional assessment or treatment by a speech-language clinician.

Child content and recordings

Your child's pronunciation attempts and voice recordings belong to the child and to you, the parents. We receive only a limited license — to process them to deliver the service (pronunciation scoring, and showing them to the speech clinician if you consented), and only if you separately opted in, to improve our speech-recognition model. We have no right to use them for advertising, sale, or any other purpose.

Termination

You may delete your account anytime from the Parent Area. We may suspend an account if we detect serious violations of these Terms (e.g. abuse, attempts to break into other accounts). Where possible we'll contact you before suspending.

Limitation of liability

To the extent permitted by law, our liability is limited to amounts you paid us in the 12 months preceding the event (if any). We are not liable for indirect damages, data loss, or lost profits. Nothing in these Terms limits liability that cannot be limited by law (e.g. direct personal injury or fraud).

Governing law and jurisdiction

These Terms are governed by the laws of Israel. Any dispute will be heard in the competent courts in Tel Aviv-Jaffa. If you are a user in the EU or UK, you remain entitled to the rights granted by your local law, and nothing in this section overrides them.

Changes

We will notify you of material changes by email and ask for renewed acceptance. Minor changes will be published here with a new updated date.
